论举证责任倒置在医疗纠纷中的适用

摘 要

随着医疗事业的发展和人们维权意识与法律意识的增强，医疗纠纷已经成为全社会关注的热点问题之一，医疗纠纷诉讼案件也呈逐年上升之势。最高人民法院《关于民事诉讼证据的若干规定》确立了医疗侵权纠纷中适用举证责任倒置规则，这种举证责任规则从一定程度上平衡了医患双方在信息占有上的不对等地位，部分免除了患者的举证责任，扩大了对患者的保护范围，加重了医疗机构在诉讼中的举证责任。本文从举证责任倒置的含义及特点着手，对举证责任及其法律特征、举证责任倒置及医患双方的责任分配等问题作了一些初步的探讨，正确认识医疗纠纷中的举证责任倒置问题，努力构建相互信任的医患关系，依法保护医患双方合法权益，维护社会安定秩序，促进医疗事业健康发展。

Abstract

With the development of medical people to safeguard their rights and legal awareness and sense of the increase in medical disputes has become all the hot issues of social concern of the medical dispute cases is also a rising trend year by year. This article from the burden of proof inverted the meaning and characteristics proceed, the burden of proof and its legal characteristics, the inversion of the burden of proof and the responsibility of both doctor-patient distribution and other issues made some preliminary discussion, A correct understanding of medical disputes in the inversion of the burden of proof issue, and strive to build mutual trust in the doctor-patient relationship, to protect the legitimate rights and interests of both doctors and patients, safeguard social stability and order, promote the healthy development of medical cause.
