《公共图书馆法》的研究制定从2008年年初正式启动。今年4月，法律草案通过国务院常务会议审议，并提请全国人大常委会审议。经过二审，法律于今年11月4日经十二届全国人大常委会第三十次会议表决通过，正式颁布。

据文化部党组副书记、副部长杨介绍，《公共图书馆法》是十九大之后出台的第一部文化方面的法律，也是公共文化领域继《公共文化服务保障法》之后的又一部重要法律。

记者梳理发现，早前多个省市曾相继出台有关公共图书馆的《管理办法》(或《管理条例》)，对公共图书馆应提供的服务做出规定，但相对比较零散。

此次《公共图书馆法》对公共图书馆的建设、运行、服务、管理和保障等作出了具体规定，尤其是在免费服务方面，提到了四类：分别是文献信息查询、借阅;阅览室、自习室等公共空间设施场地开放;公益性讲座、阅读推广、培训、展览;国家规定的其他免费服务项目。

而在监督层面，《公共图书馆法》规定，公共图书馆应当改善服务条件、提高服务水平，定期公告服务开展情况，听取读者意见，建立投诉渠道，完善反馈机制，接受社会监督。

至于公共图书馆如何开展服务、服务水平如何提高等问题，《公共图书馆法》也给出了明确规定，并给出了考核措施。

例如，以前不少读者都碰到过图书馆周末、节假日不开放的情况。《公共图书馆法》指出：公共图书馆在公休日应当开放，在国家法定节假日应当有开放时间。而且应当通过其网站或者其他方式向社会公告本馆的服务内容、开放时间、借阅规则等;因故闭馆或者更改开放时间的，除遇不可抗力外，应当提前公告。

针对少年儿童、老年人和残疾人，《公共图书馆法》也在阅读区域方面有所设置，一是政府设立的公共图书馆应当设置少年儿童阅览区域，并配备相应的专业人员，开展面向少年儿童的阅读指导和社会教育活动，并为学校开展有关课外活动提供支持，有条件的地区可以单独设立少年儿童图书馆;二是应当考虑老年人、残疾人等群体的特点，积极创造条件，提供适合其需要的文献信息、无障碍设施设备和服务等。并且应当根据自身条件，为国家机关制定法律、法规、政策和开展有关问题研究，提供文献信息和相关咨询服务。

这些服务项目应该如何规范?《公共图书馆法》要求，各级主管部门应制定公共图书馆服务规范，对公共图书馆的服务质量和水平进行考核。考核应当吸收社会公众参与。考核结果应当向社会公布，并作为对公共图书馆给予补贴或者奖励等的依据。

保障读者信息杜绝泄露行为

在图书馆借书一般需要办理借阅卡等，这样就得先登记个人信息。那么，如何保护读者的个人信息不被泄露呢?《公共图书馆法》做出了相关规定。

《公共图书馆法》明确指出，公共图书馆应当妥善保护读者的个人信息、借阅信息以及其他可能涉及读者隐私的信息，不得出售或者以其他方式非法向他人提供。如果公共图书馆及其工作人员涉嫌出售或者以其他方式非法向他人提供读者的个人信息、借阅信息以及其他可能涉及读者隐私的信息，将由文化主管部门责令改正，没收违法所得。

参与公共图书馆建设

针对公共图书馆的建设问题，《公共图书馆法》也给出了相关规定。如鼓励公民、法人和其他组织依法向公共图书馆捐赠，并依法给予税收优惠;境外自然人、法人和其他组织可以依照有关法律、行政法规的规定，通过捐赠方式参与境内公共图书馆建设等。

同时，为了优化资源配置，推动社会力量参与公共图书馆建设，《公共图书馆法》规定，公共图书馆可以以捐赠者姓名、名称命名文献信息专藏或者专题活动;公民、法人和其他组织设立的公共图书馆，可以以捐赠者的姓名、名称命名公共图书馆、公共图书馆馆舍或者其他设施。当然，以捐赠者姓名、名称命名应当遵守有关法律、行政法规的规定，符合国家利益和社会公共利益，遵循公序良俗。

另外，对于公共图书馆自身建设问题，《公共图书馆法》给出了明确说法：公共图书馆可以通过采购、接受交存或者捐赠等合法方式收集文献信息。
