对于《通知》中提及的征地补偿新标准，朱留华阐释，征地补偿新标准指的是各地公布实施的征地统一年产值标准和区片综合地价。

新标准的实施使征地补偿标准测算方式更加合理，改变了以往按被征耕地具体地块的年产值测算征地补偿标准的方式。其中，征地统一年产值是综合考虑一定区域内农用地的年产值来测算征地补偿标准;征地区片综合地价是综合考虑一定区片范围内土地类型、产值、土地区位、当地经济发展水平和城镇居民最低生活保障水平等多方面因素测算的征地补偿标准。这次补偿标准普遍提高，提高幅度平均在

征地补偿费直接支付给农民，防止截留、挪用

《通知》指出，征地补偿费应在征地补偿安置方案批准之日起3个月内支付到位。为了保证农民能够得到自己的征地补偿费，首先，要求建设项目将征地补偿费足额列入项目投资概算。其次，征地批准后，市县国土资源部门要按照确定的征地补偿安置方案，将应支付给被征地农民的补偿安置费，直接支付给农民个人，不再通过乡、村等环节支付，防止截留、挪用征地补偿费问题。第三，健全反馈制度，要求市县国土资源部门在规定时间内向部、省报告征地补偿费用落实到位等批后实施情况，切实加强征地批后实施监管。

朱留华说，征地补偿费依法部分支付给被征地农村集体经济组织，部分支付给被征地农民，具体分配办法由省级政府作出规定。根据当地的分配办法，结合安置方式，将核定的应支付给被征地农民的补偿费，由当地实施征地的部门直接支付给农民个人。“建议各地利用给农民个人的农业补贴等有关资金直接支付渠道，将征地补偿费直接支付给农民”。

朱留华解释说，先安置后拆迁不是简单的指先建后拆，而是指在实施拆迁前，应采取多种方式妥善安排好被拆迁农户的居住问题，包括建好安置房或制定切实可行的安置方案并征得被拆迁农户同意，防止拆迁后农民居住无着落，影响生产生活。拆迁补偿安置方案要因地制宜合理制定。在城市远郊和农村地区，主要采取迁建安置方式，重新安排宅基地建房。在城乡结合部和城中村，主要采取货币或实物补偿的方式，由被拆迁农户自行选购房屋或政府提供的安置房。被拆迁农户所得的拆迁补偿以及政府补贴等补偿总和，应能保障其选购合理居住水平的房屋。在城乡结合部拆迁中，货币补偿主要是指支付补偿费用由被拆迁农户自行购房，实物补偿主要是指建造安置房安排被拆迁农户居住。实际操作中，具体采取哪种方式、如何补偿安置，由当地政府结合本地实际与被拆迁农户协商确定。

朱留华说，先安置后拆迁要求地方政府根据城市发展需要，合理预测一段时期内征地涉及的农民住房拆迁安置规模，统筹规划，对拆迁安置用地和建造安置住房提前作出安排，有序组织拆迁工作。

准建立新型农村社会养老保险制度。在新农保试点地区征地时，被征地农民已纳入新农保的，还应落实被征地农民的社会保障，实行“双保”，不得以新农保代替被征地农民的社会保障。

涉及被征地农民利益的程序不能减少和简化

朱留华说，简化征地批后实施程序，是指征地报批前已先行拟订了征地补偿安置方案、并已征求群众意见的前提下，在征地批准后可将征收土地公告和征地补偿安置方案公告同步进行，以提高工作效率。实际是尽可能将征地程序前置，不搞程序上的重复。对涉及被征地农民利益的告知、确认、听证等程序，不能减少和简化，不会因此造成征地纠纷。
