甲乙双方经友好协商,按照《中华人民共和国合同法》、《中华人民共和国劳动合同法》的有关规定,就乙方派遣符合甲方要求的被派遣劳动者(以下简称“劳动者”)为甲方提供劳务服务,协议达成一致,订立如下协议:
一、在本协议期限内,双方同意按以下程序接受和提供劳务派遣服务。
1、甲方向乙方发出《用工需求通知书》包括:岗位描述、人数、用工基本要求、工作内容、工作地点、工作条件、报酬待遇等内容。
2、甲方所需劳动者,由甲方招聘或委托乙方招聘,或双方联合招聘。3、根据甲方确认接受的劳动者名单,由甲方向乙方开出《用工通知单》。4、乙方根据甲方的《用工通知单》上确认的劳动者名单与劳动者签订劳动合同,并向甲方开具《劳务派遣介绍信》。
5、劳动者持乙方《劳务派遣介绍信》到甲方报到,甲方根据乙方《劳务派遣介绍信》接收劳动者并安排用工。

6、对符合退工条件的劳动者由甲方向乙方开具《退工通知单》退回乙方,由乙方办理相关手续。
二、甲方的权利与义务
1、劳动者所从事的具体工作由甲方安排,甲方有权根据本单位生产和工作的需要及劳动者的综合素质、业务水平等情况,在乙方与劳动者的劳动合同约定的岗位范围内,调整劳动者的具体岗位。如需调整到劳动合同约定以外的岗位,甲方应与劳动者协商一致后调整,并书面通知乙方。
2、甲方应当按照国家有关法律、法规的要求为劳动者提供劳动安全职业卫生条件,提供必要的劳动工具和劳动保护,执行国家劳动标准、规定的工时和休息休假等制度。
3、甲方有权根据工作需要,依据国家有关法律、法规制定各项规章制度及薪酬考核办法等,并应将直接涉及劳动者切身利益的规章制度和重大事项(如工作要求、劳动报酬、福利待遇等)告知劳动者。
4、甲方可就有关事项直接与劳动者签订专项协议(如培训协议、保密协议等),专项协议需及时送交乙方备案。
5、如劳动者有下列情况之一的,甲方有权退回乙方,并以《退工通知单》的形式书面通知乙方。
(1)在试用期被证明不符合录用条件的;(2)严重违反甲方合法有效规章制度的;
(3)严重失职,营私舞弊,给甲方造成重大损害的;
(4)同时与其他用人单位建立劳动关系或提供劳务服务,对完成甲方的工作任务造成严重影响,或者经甲方或乙方提出,拒不改正的;
(5)被依法追究刑事责任的;
(6)乙方或劳动者以欺诈、胁迫的手段或者乘人之危,使甲方在违背真实意思的情况使用被派遣劳动者的;
(7)因患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事由甲方另行安排的工作的;
(8)不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;(9)国家和地方相关法律、政策及甲方用工政策调整、或者订立本协议时所依据的客观情况发生重大变化,致使本协议无法履行的;
(10)双方协商一致或符合法律、政策法规规定的其他情形。
其中甲方依据(7)、(8)、(9)、(10)款情形之一退回劳动者的,甲方应提前三十日通知(或额外支付劳动者一个月工资)乙方及劳动者本人。
