论中国特色社会主义法治道路的本质特征

[摘要] 2014年10月召开的中国共产党十八届四中全会明确指出“坚定不移走中国特色社会主义法治道路”，这标志着中国特色社会主义法治道路已经形成。其本质特征主要体现在四个方面，即在社会主义初级阶段基础上的法治道路；由执政党直接领导和推进的法治道路；突出依法执政的法治道路；立足中国国情，并吸取人类其他法治有益经验的法治道路。 [关键词] 中国特色社会主义；法治道路；本质特征

Abstract：The Fourth Plenary Session of the Eighteenth Central Committee of the Party laid that unswervingly follow the path of socialist rule of law with Chinese characteristic， which means the path of socialist rule of law with Chinese characteristic has been formed. This path indicated four essential features， that is： This path of rule of law is on the base of the primary stage of socialism； The path of rule of law is leaded and promoted by the ruling party； The path of rule of law emphasizes exercising the state power in accordance with law； The path is based on China’s national conditions， and absorbs fruits of the civilization of rule of law achieved by human societies. 法治道路的选择对于一国法治的实现至关重要，对我国也不例外。世界各国的法治道路并没有一个统一的模式，都呈现出自己的特色，既有自上而下的政府推进型模式，也有自下而上的社会自然演进模式；既有西方资本主义国家的法治发展模式，也有社会主义国家的法治发展模式；既有法国及欧洲大陆国家法治发展模式，也有英国资产阶级法治发展模式，还有美国法治发展模式[1]（P253）等等。可见，各国法治道路呈现的是多样性，而不是统一性。我国在中国共产党的领导下，在总结近代以来长期斗争以及现阶段社会主义建设经验的基础上，在党的十八届四中全会上明确提出了“坚定不移走中国特色社会主义法治道路”。中国特色社会主义法治道路是中国特色社会主义道路的有机组成部分， 它和其他国家的法治道路相比较，特色主要体现在四个方面，也就是说，它具有以下四方面的本质特征。
