论夫妻忠实义务与隐私权冲突的法律协调

摘要：

虽然我国现行立法对配偶权没有做出明确规定，但已有相关法律条文规定了配偶的忠实义务。对配偶忠实请求权的保护，离婚损害赔偿的实现，都会涉及配偶隐私权、第三人隐私权的保护。不可否认的是配偶忠实义务与隐私权保护存在一定的冲突，而在利益冲突时如何取舍、协调与平衡一直是法学理论界和司法实践探讨的话题。本文就夫妻忠实义务与隐私权冲突的法律协调问题进行初步探讨。

Abstract:

Although China's current legislation on the right of spouse is not made clear, but the existing related legal provisions in the spouses of the duty of loyalty.Faithful to their spouses request rights, divorce damages to the implementation, will involve spouses privacy, third people the protection of privacy.There is no denying that spouses faithful obligation and right of privacy protection exist some conflicts, and in a conflict of interest when the trade-offs, coordination and balance has been the legal theory and judicial practice, the topic of discussion.In this paper, the faithful duty of husband and wife and the right to privacy law coordination problem to undertake preliminary discuss.
