总包单位：xxxxxxxxx新区项目部（以下简称甲方） 分包单位：xxxxxx身份证号码：（以下简称乙方）

由甲方承包的xxxxxxx水电安装工程，经过商议和对比，决定将

此工程安装费（辅材除外）部分，遵循平等、公平和诚实守信的原则，经双方

协商一致，订立本协议。 一、工程概况：

1、工程名称：xxxxxxxxxx 2、工程地点：城南路 3、工程内容：水电安装 二、施工日期：

以业主的工期要求为根据，乙方只可提前，不得延误，如因为乙方原因造成甲方工期达不到业主要求所引起的一切责任与经济损失均由乙方承担。 三、工程质量：

乙方本着创精品工程，树公司形象的原则精心组织、规范施工，服从甲方现场项目部指挥，确保所施工的工程达到甲方与业主的要求，根据国家验收标准乙方保证工程一次性验收100％达到合格标准，如因为乙方原因造成甲方工程质量验收不合格或达不到业主要求所引起的一切责任及经济损失均由乙方承担。

四、文明施工：

1、乙方在施工现场尽量统一着工作服上班，进入施工现场一定要戴好安全帽，系好安全带，高空作业系好保险带等劳保用品，

2、乙方应按照有关规定，采取严格的安全防范措施，承担由于自身安全措施不当而造成的事故责任，切实做到文明施工，安全生产。

3、施工人员（包括管理人员）在工作期间不得酗酒、打架，如一经发现每次罚款200元，严禁偷窃工地材料，如果发现确认按照被窃材料单价10倍的罚款，严重的送公安机关处理。

4、宿舍要整洁、临时施工用电用水要规范，如果因乙方违章作业或不采取安全防范措施等被业主、监理、安监部门查实处以的罚款由乙方自己负责，甲方有权对乙方处于3倍以上的罚款。

5、甲方配备专职的安全员，乙方必须服从指挥，做到无一般（火警、机械、电器设备、交通、食物中毒等）事故，杜绝重大伤亡事故。

6、以上任何一条如因乙方不遵守，甲方有权利给予相应的处罚和辞退，工资按分包协议书中完成任务的50%结帐。 五、施工范围：

xxxx工地包括所有招标合同工程内容里的安装、试压、调试直至竣工验收合格为止。 六、工程资料：

1、乙方在工程施工期间必须及时向甲方提供工序报验、隐蔽工程验收、分部分项工程验收及有关工程资料，并在工程结束后向甲方提供竣工图纸。 七、材料供应：

1、乙方所需施工材料应该提前两天以书面形式申报给甲方，经项目部核定后，由甲方统一上报材料部采购。零星材料三~七天到场，大型材料十天~半个月到场。 八、付款方式：

1、甲方根据乙方现场施工人员及施工进度、质量每月给生活费，但不超出安装工程分包协议书上所完成工程量的70%（农忙、小孩上学另行考虑）。

2、工程竣工验收合格后，甲方在次月内一次性给乙方结清。

3、乙方应上报当月的进度月报表、施工人员考勤表，乙方可以每月支取1000~XX元备用资金。 九、工程安装费结算方式：

根据甲、乙双方协商总工程款为九万元根据图纸所有内容一次性包定，不作任何调整，图纸以外变更内容的工程量按照造价的10%计算人工费。 十、双方职责：

1、甲方提供乙方工程图纸，并进行相关交底，负责协调施工中的各部环节，确保乙方工程施工的顺利进行，

2、根据现场施工进度情况及时将主材、辅材采购到工地现场。

3、负责对乙方班组人员进行技术交底、安全交底，全面督促乙方做好各项安全生产工作，并对乙方违反安全生产规定者采取必要的罚款等措施。

4、依据业主、监理单位意见，及时制定出各阶段的施工计划，并以书面形式通知乙方，确保工程施工有序进行。

5、乙方应爱惜甲方配备的施工设备和工具，安排技术过硬的施工队伍进行施工，如果因为乙方原因而引起的返工、材料损失、经济损失等均由乙方承担。

6、乙方在拿到工程款后不得拖欠施工人员生活费和工资。 7、材料进入施工现场，乙方应积极安排人员卸货入库，领料应办好相应的入库手续。

8、乙方领材料应按施工图纸，工程完工后应当做好成品保护工作。

9、乙方在施工过程中不得浪费材料，或大料小用。如果发现一律按照成品材料价格扣除，人工费作为对充。

10、乙方如果因使用不当或人为破坏造成甲方提供的机具、设备损坏（包括遗失）由乙方照价赔偿，费用从承包工程款中扣除。

11、乙方应当做到工完场清、材料清，对施工设备和工具、剩余材料应当归集交仓库，并做好交接记录。如果发现现场有遗失材料和工具设备，甲方有权作出相应的处罚。

十一、本协议以上条款由甲、乙双方确认签字后即日生效，删改或添加条件无效。

十二、本协议中其它未尽事由双方共同协商解决。
