诊疗护理规范、常规：诊疗护理规范分为广义和狭义两种，广义的是指卫生行政部门以及全国性行业学(协)会针对本行业的特点，制定的各种标准、规程，如《临床输血技术规范》《医院感染管理规范》《医院感染论断标准》《医院消毒卫生标准》《医院消毒供应验收标准》《医疗机构和治疗仪器应用规范》等，狭义的是指医疗机构制定的本机构医务人员进行医疗、护理、检验、医技诊断治疗及医用物品供应等各项工作应遵循的工作方法、步骤。

第三，医疗事故是医疗机构及其医护人员的过失行为。

这里把医疗事故的主观方面定义为医疗机构及其人员的过失”。这里的过失是指对于可能给患者造成的损害应当预见而没有预见或者虽然预见了但轻信能够避免的。这就把医疗机构和医护人员的故意行为排除在医疗事故之外，如果患者的损伤是由医疗机构和医护人员的故意行为造成的，那么，这不属于医疗事故，患者应该从其他法律方面追索赔偿，并可以追究医疗机构和医护人员的刑事责任。

《医疗事故处理办法》规定只有造成病员死亡、残废、组织器官损伤导致功能障碍的才构成医疗事故，而《医疗事故处理条例》规定，只要是过失行为造成了患者的人身损害，就构成了医疗事故，扩大了医疗事故的认定范围。

根据《医疗事故处理条例》的规定，只有符合了上述四个方面，才能够构成医疗事故，同时，该《条例》又对不构成医疗事故的几种情况做了明确的规定：《医疗事故处理条例》第三十三条规定有下列情形之一的，不属于医疗事故：

(一)在紧急情况下为抢救垂危患者生命而采取紧急医学措施造成不良后果的;

(二)在医疗活动中由于患者病情异常或者患者体质特殊而发生医疗意外的;

(三)在现有医学科学技术条件下，发生无法预料或者不能防范的不良后果的;

(四)无过错输血感染造成不良后果的;

(五)因患方原因延误诊疗导致不良后果的;

(六)因不可抗力造成不良后果的。
