医疗事故再次鉴定申请书

申请事项：申请对申请人与被申请人之间的医疗纠纷作再次医疗事故技术鉴定

申请理由：

申请人与被申请人医疗纠纷一案，经兰州市医学会于2017年×月×日作出兰州医鉴××号《兰州医学会医疗事故技术鉴定书》(下称鉴定书)，结论为不构成医疗事故。申请人不服兰州市医学会的鉴定结论，理由如下：

一、被申请人的医疗行为违反医疗卫生管理法律、行政法规、部门规章和诊疗护理规范、常规。

(1)××人民医院及其医务人员未将医疗措施、医疗风险等如实告知患者，违反《医疗事故处理条例》规定的法定告知义务。

(2)在双侧甲状腺次全切除手术结束后，监护室医务人员违反××医生24小时后拔除插管的医嘱，在手术结束仅45分钟就拔除气管插管，导致患者呼吸困难、病危，被行气管切开手术。

(3)在申请人出院后，申请人提出复印其住院病历资料，被申请人拒不提供气管切开手术资料的复印。

(4)在医疗事故鉴定过程中，被申请人不配合兰州医学会的调查，未提供全部病历资料(例如未提供气管切开手术的手术记录及病程记录)，导致不能重现医疗过程，同时也使医疗鉴定缺失重要的基础，严重影响医疗事故技术鉴定的科学性、完整性和公正性。试问：医方没有提供气管切开手术的任何资料，兰州医学会作出“诊断明确，手术方案正确”的分析意见，是臆想还是揣测?

二、鉴定书存在明显不当或错误之处

1、“分析意见”模糊不清、成因不清。

鉴定书认为，“术后气管切开与肿瘤长期压迫气管造成气管软化、塌陷有关;造成切口长期不愈，与巨大肿瘤切除后留下残腔、局部感染有关。左声带麻痹、声音嘶哑与喉返神经损伤有关”。与被申请人气管被切开、切口长期不愈、左声带麻痹、声音嘶哑有关的因素还有哪些?与被申请人的医疗行为有没有关?只是简单一句“与某某有关”判断不明，作为一个专门医疗事故鉴定机构下这样简单的结论，不符合起码的医学科学常识。

2、“分析意见”自相矛盾。

(1)术前，医方的诊断结论中仅有“气管受压右移”，并没有“肿瘤长期压迫气管造成气管软化、塌陷”这一内容。既然被申请人的“诊断明确”，为什么病历上没有“肿瘤长期压迫气管造成气管软化、塌陷”的内容?鉴定书认为术后气管切开与肿瘤长期压迫气管造成气管软化、塌陷有关的依据又是什么?监护室医务人员违反××医生的医嘱拔除气管插管导致患者窒息是申请人被行气管切开手术的真正原因。

(2)申请人于9月8日出院，9月9日发现气管切口处流液，随即多次诊疗，切口长期不愈。“分析意见”认为是“局部感染”所致

切口长期不愈，那么试问：出院第二天就发现切口处流液，难道这个“局部感染”是一夜之间形成?被申请人在申请人住院期间怎么没有诊查出并治愈局部感染呢?手术区域留有碎骨是造成患者切口长期不愈、流脓出血的真正原因。

(3) “分析意见”认为申请人“左声带麻痹、声音嘶哑与喉返神经损伤有关”， 在双侧甲状腺次全切除术中，手术记录没有记载申请人的喉返神经受到损伤，那么申请人的喉返神经是如何受到损伤的?气管塌陷、喉返神经损伤不是甲状腺肿瘤切除手术的并发症，相反，在该类手术中导致喉返神经损伤的，都是医生的解剖没有学好。

(4)鉴定中如实完整提供病历资料和记录是医院的义务，但被申请人没有提供气管切开手术的术前讨论资料、手术记录、病程记录被轻描淡写成“医方存在不足”。作为一个三级甲等医院可以在做完一个手术后不留下任何记录?如果是这样，那被申请人诊疗行为的合法性、是否遵守诊疗护理规范、常规将令人质疑。如果不是这样，那么就是被申请人隐匿了气管切开手术的病历资料。否则，再没有合适的解释理由。

3、鉴定书缺少以下主要内容，既不严谨、也不科学。

故技术鉴定书》缺失下列主要内容：

(一)医疗过失行为与人身损害后果之间是否存在因果关系;

(二)医疗过失行为在医疗事故损害后果中的责任程度;

(三)对医疗事故患者的医疗护理医学建议。

综上所述，被申请人未履行告知义务，违反医疗卫生管理法律、行政法规、部门规章和诊疗护理规范、常规，导致申请人受到身体损害。兰州医学会的鉴定存在明显不当或错误，不严谨，也不科学。所以，申请甘肃省医学会组织该病例医疗过程中是否存在医疗过失，是否构成医疗事故，和损害后果是否有因果关系予以再次鉴定。 此致
