浅论我国婚姻法关于夫妻共同财产分割的规定及其完善

【摘 ; 要】 现代社会越来越发达，人们的财富累计也是越来越多。但是伴随着的也是越来越高的离婚率。针对于这种现象，我国一直有在更新和修订婚姻法，其目的就是为了保证夫妻双方的权益，不让某一方受到关于财产的侵害。在我国司法案例的实践中，夫妻双方就共同财产问题有很多的牵扯和纠葛，当夫妻双方感情破裂需要离婚时，双方的共同财产分割问题更为棘手和麻烦。夫妻共同财产分割的的纠葛对于很多夫妻共同财产分割的理论发起了巨大的挑战，不得不迫使夫妻共同财产分割的法律法规得到调整和相应地补充。但是，中国离婚夫妻共同财产分割仍存在一些棘手问题。 【关键词】 婚姻法;夫妻财产;规定完善

On the provisions and perfection of the Marriage Law of our country concerning the division of the joint property of husband and wife

[Abstract] ;With the development of modern society， people's wealth is also

increasing. ;However， the divorce rate is also increasing.But it is also accompanied by a rising divorce rate.In response to this phenomenon， our country has been updating and revising the marriage law， the purpose of which is to ensure the rights and interests of both husband and wife and to prevent one party from being infringed upon by property. In the practice of judicial cases in our country， both husband and wife have a lot of involvement and disputes on the issue of common property. When the relationship between husband and wife breaks down and divorce is needed， the division of common property between both parties is more difficult and troublesome.The

entanglements of the division of husband and wife's common property have posed great challenges to many theories of the division of husband and wife's common property， forcing the laws and regulations governing the division of husband and wife's common property to be adjusted and supplemented accordingly.However， there are still some thorny problems in the division of the common property of divorced couples in China.
